The Client expressly agrees that the use of the service is at their sole risk. The service is provided “as is” and “as available”.
MySafeSecurity expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
MySafeSecurity makes no warranty that the service will meet the Client’s requirements or that the service will be uninterrupted, timely, secure, or error-free…
MySafeSecurity makes no warranty regarding the results that may be obtained from the use of the service or the accuracy or reliability of any information obtained through the service.
The Client understands and agrees that any material and/or data downloaded or otherwise obtained through the use of the service is done at the Client’s own discretion and risk, and that the Client will be solely responsible for any damage to the Client’s Cloud-Computing or OS systems resulting from the download of such material and/or data. No advice or information, whether oral or written, obtained by the Client from MySafeSecurity or through the service shall create any warranty not expressly made herein. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to each Client. It is the Client’s responsibility to back up all data on computers and other devices.
MySafeSecurity will not be held responsible for the loss of the Client’s local & Cloud data: limitation of liability.
MySafeSecurity shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use the service or the cost of procurement of substitute goods and services or resulting from any goods or services purchased or obtained or messages received or transactions entered into through the service or resulting from unauthorized access to or alteration of the Client’s transmissions or data, including but not limited to, damages for loss of profits, use, data or other intangibles, even if MySafeSecurity has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages.
All Cloud services provided in the contract will be within the limits of the Cloud provider’s free service.
MySafeSecurity cannot be responsible for loss or damage of data stored on third-party Cloud servers. It is the Client’s responsibility to back up software and data stored on the Client’s computers, hard drives and/or any other storage devices they may have. MySafeSecurity will at no time be responsible for any loss, alteration or corruption of any software, data or files…
MySafeSecurity shall in no event be liable for damages resulting from any part, equipment, device, software or other product supplied to the Client by MySafeSecurity.
Notwithstanding anything to the contrary, MySafeSecurity’s maximum liability to the Client arising out of or related to MySafeSecurity under this agreement shall be limited to the amounts paid by the Client to MySafeSecurity under this agreement during the 3 months preceding the time when the cause of action arose.
The Client shall have the right to withdraw from the contract, taking into account that they will have to bear all costs of technical interventions:
– Complete cleaning of the operating system;
– Computer optimization;
– Installation of the comprehensive security suite with a nominative and irrevocable license key.
Within 14 calendar days from the date of acceptance of the contract and the start of the contracted goods or services.
To do this, the form available for this purpose must be completed and returned on the MySafeSecurity website (https://mysafesecurity.net/conatct-us).
The resulting refund to the Client will be processed within 30 calendar days from the date of receipt of the refund request or, if applicable, from the date of receipt of the material returned to MySafeSecurity.
There will be no refund made if the Client does not authorize remote access to our certified technicians to:
– Perform a restore point;
– Uninstall all Cloud-related services;
– Uninstall the licenses of the provided Microsoft Office 365 applications;
– Uninstall the Comprehensive Security
Suite they have benefited from.
If a Client has already used the installation, configuration, or restoration services.
